Terms of Service
Effective September 5, 2026
These Terms form a binding agreement between you and NFLUENCY, the operator of CommenCents, a budgeting service created for the men of IKON21. By creating an account, selecting Continue with Google, or otherwise using the service, you agree to these Terms and acknowledge the Privacy Policy.
1. Eligibility and acceptance
You must be at least 18 years old, or the age of legal majority where you live, and legally able to enter this agreement. If you use CommenCents on behalf of an organization, you represent that you have authority to bind that organization. You must provide accurate account information and use the service in compliance with applicable law.
If you do not agree to these Terms, do not create an account or use CommenCents.
2. Accounts and access
You are responsible for protecting your login credentials and for activity under your account. Use your own account, do not share passwords, and notify us promptly if you suspect unauthorized access. We may suspend or restrict access when reasonably necessary to protect users, the service, or third parties.
Google sign-in is optional. If you use it, your relationship with Google is also governed by Google's applicable terms. Our handling of Google account data is described in the Privacy Policy.
You may not transfer your account without our written permission. You are responsible for maintaining a current email address so that we can send account, security, and legal notices.
3. The service
CommenCents provides tools for recording income, planning budget categories, tracking manually entered transactions, reviewing activity, and receiving Bookkeeper assistance. Features may change, improve, pause, or be discontinued as the service develops.
Unless clearly stated otherwise, CommenCents does not connect to a bank, move money, make payments, file taxes, execute investments, or verify that entries are complete or accurate.
4. Bookkeeper and financial disclaimer
The Bookkeeper uses artificial intelligence and deterministic tools to provide educational budgeting assistance. AI responses may be incomplete, outdated, or incorrect. Calculations and transaction drafts should be reviewed before you rely on them.
CommenCents does not provide financial, investment, accounting, tax, legal, or fiduciary advice. Nothing in the service creates a professional-client relationship. You remain responsible for your decisions and should consult a qualified professional when advice is needed.
The Bookkeeper cannot save a transaction without your confirmation, move funds, connect accounts, or act on your behalf.
5. Your content
You retain ownership of information you submit. You grant NFLUENCY and its service providers a worldwide, nonexclusive, royalty-free license to host, reproduce, process, transmit, and display that content only as reasonably necessary to provide, secure, maintain, and support CommenCents, fulfill your requests, and comply with law. This license ends when the content is deleted from active systems, subject to reasonable backup, security, and legal-retention periods.
You represent that you have the right to submit your content. Do not enter another person's confidential or personal information unless you are authorized to do so.
Google user data obtained through OAuth is subject to the narrower uses and restrictions described in the Privacy Policy and is not licensed for advertising, sale, credit decisions, lending, data brokerage, or generalized AI or machine-learning training.
6. Acceptable use
You may not:
- Use the service for unlawful, fraudulent, abusive, or deceptive activity.
- Attempt to access another user's account, workspace, or data.
- Probe, bypass, disable, or interfere with security, authentication, rate limits, or access controls.
- Upload malicious code or use automation that disrupts or unreasonably burdens the service.
- Misrepresent Bookkeeper output as professional advice or use the service to make automated high-impact decisions about another person.
- Copy, resell, reverse engineer, or exploit the service except where applicable law expressly permits it.
7. Ownership
CommenCents, its design, software, branding, and service content—excluding your content—are owned by or licensed to NFLUENCY and protected by applicable intellectual-property laws. Subject to these Terms, NFLUENCY grants you a limited, revocable, nonexclusive, nontransferable right to access and use CommenCents for its intended personal budgeting purpose.
If you provide suggestions or feedback, you permit us to use them without restriction or compensation, but you are not required to provide feedback. IKON21, NFLUENCY, Google, Supabase, Vercel, and other names or marks belong to their respective owners.
8. Third-party services
The service relies on third parties including Supabase, Google, and Vercel. Their systems and terms may affect availability and processing. We are not responsible for third-party products or services that we do not control.
9. Fees and future paid features
CommenCents may currently be offered without charge. We may introduce paid features later, but we will disclose the price, billing terms, renewal terms, and cancellation method before charging you. You are responsible for taxes associated with any future purchase unless law requires us to collect them.
10. Availability and termination
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. You may stop using CommenCents at any time. You may request account deletion by contacting us. We may suspend or terminate access for material violations, legal or security risk, discontinuation, or prolonged inactivity, subject to applicable law.
Upon termination, your right to use the service ends. Provisions that by their nature should survive—including ownership, disclaimers, liability limitations, dispute terms, and amounts owed—will survive.
11. Disclaimers
To the maximum extent permitted by law, CommenCents is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service or Bookkeeper output will be accurate, complete, secure, or suitable for your circumstances.
You are responsible for maintaining independent copies of information you need for tax, accounting, legal, or recordkeeping purposes. CommenCents is not a bank, money transmitter, registered investment adviser, accounting firm, or tax preparer, and funds are never held or insured by CommenCents.
12. Limitation of liability
To the maximum extent permitted by law, NFLUENCY and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from use of the service. Our aggregate liability for claims relating to the service will not exceed the greater of $100 or the amount you paid for the service during the 12 months before the claim.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless NFLUENCY and its officers, personnel, affiliates, and service providers from third-party claims, damages, and reasonable costs arising from your unlawful use of CommenCents, your content, or your material breach of these Terms. This obligation does not apply to the extent a claim results from our own negligence or misconduct.
14. Disputes and governing law
Before filing a formal claim, you and NFLUENCY agree to make a good-faith effort to resolve the dispute by sending a written description to the contact address below and allowing 30 days for a response. This requirement does not prevent either party from seeking urgent injunctive relief or using an available small-claims process.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where the law where you live requires otherwise. Any dispute will be brought in a state or federal court with proper jurisdiction in California, and each party consents to that court's jurisdiction, except where applicable consumer law requires another forum.
15. Changes to these Terms
We may update these Terms as the service evolves. We will post the updated version and effective date and provide additional notice when required. Continued use after an update takes effect constitutes acceptance where permitted by law.
If a material change requires affirmative consent under applicable law, we will request it before the change applies to you.
16. General provisions
These Terms and the Privacy Policy are the entire agreement between you and NFLUENCY concerning CommenCents and replace prior discussions about the service. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver.
You may not assign these Terms without our written permission. We may assign them in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of the service, subject to applicable notice requirements. Neither party is liable for delay caused by events reasonably beyond its control.
Headings are for convenience only. Electronic communications and notices satisfy written-notice requirements where permitted by law.
